This privacy notice describes how US Acute Care Solutions (“USACS,” “we,” “our,” or “us”) may collect, use, or disclose personal information including through its websites that link to this privacy notice, such as www.usacs.com, and our offline offerings (collectively, the “Services”). Please read this privacy notice before using the Services or submitting any personal information. By using the Services, you are acknowledging the practices described in this privacy notice. 

Note: This privacy notice does not apply to protected health information that we collect from individuals pursuant to the Health Insurance Portability and Accountability Act (HIPAA). Additional information regarding our privacy practices, such as how protected health information is used and disclosed and your rights to protected health information can be found in our Notice of Privacy Practices. Please review it carefully.

Collection of Personal Information

We may obtain personal information from the following sources:

• Directly from you. For example, when you sign up for email communications, use our Services, or contact us directly.
• Through tracking technology vendors. For example, via cookies and other tracking technologies (see “Cookies and Other Tracking Technologies” for more information).

Below are the categories of personal information we collect. Note that the personal information we collect about you may vary depending on the nature of your interactions with us and may not include all of the examples listed below.

Use of Personal Information

We may use your personal information for various purposes, depending on your interactions with us, including:

• To improve our Services, including personalizing your online experience, identifying and repairing issues, and improving, upgrading, and enhancing our products and Services.

• For quality, safety, and internal research, including evaluating our Services; repairing or improving the quality of our Services; tracking and responding to quality and security issues; and developing new or enhanced products and Services offerings.

• For advertising and marketing, including measuring the effectiveness of our advertising and marketing, and uncovering insights to improve our marketing.

• For security and integrity, including detecting security incidents and protecting against malicious, deceptive, or illegal activity, enforcing our policies and terms, protecting our rights, and generally providing you with a secure experience.

• For compliance, including complying with applicable laws, regulations, or legal processes.

Disclosure of Personal Information

We may disclose the above categories of personal information with our corporate affiliates, strategic partners, and other vendors that help us operate our Services. We may also disclose personal information to governmental agencies or others as required by law. We may do so when: (1) permitted or required by law; (2) trying to protect against or prevent actual or potential fraud or unauthorized transactions; (3) investigating fraud which has already taken place; (4) we sell or transfer all or a portion of our business assets (e.g., further to a merger, reorganization, liquidation, or any other business transaction) including negotiations of such transactions, in accordance with applicable laws; or (5) necessary to protect our affiliated companies, our employees, or others.  

We do not share information you provide to enroll in our text messaging services or programs with third parties for those third parties’ own marketing purposes. We may share your text messaging opt-in information or consent status with service providers that help us administer our text messaging services, including but not limited to platform providers, phone companies, and other vendors who assist us in the delivery of text messages. 

Cookies and Other Tracking Technologies

We and our vendors may use a variety of tracking technologies, including cookies, beacons, pixels, and SDKs that collect certain information when you interact with the Services. Depending on your device and browser settings, these tracking technologies may collect your IP address, device identifiers, user preferences, approximate geolocation, the pages you click on, and the website you visited immediately beforehand. Additionally, these technologies may collect details about how you interact with the Services.

We may use these technologies for various purposes, including to provide functionality to the Services, help us route traffic between servers, understand how the Services are performing, how visitors use the Services, improve features and content on the Services, and for advertising purposes. We may combine certain information collected through tracking technologies with other information we obtain about you, which may include information we obtain from our vendors. We or other parties may collect personal information about your online activities over time when you use the Services.

You can opt-out of Google Analytics advertising features directly with Google through its Ads Settings, Ad Settings for mobile apps functionality, or downloading the Google Analytics Opt-out Browser Add-on.

Certain advertising tracking technology vendors may participate in the Digital Advertising Alliance (“DAA”) AdChoices Program and may display an Advertising Option Icon for Interest-based Ads that links to an opt-out tool which allows you to exercise certain choices regarding targeting. Please be aware that, even if you are able to opt-out of certain kinds of interest-based ads, you may continue to receive non-targeted ads.

In addition, certain advertising networks and exchanges we work with may participate in the Network Advertising Initiative (“NAI”). You may be able to adjust your browser settings to remove or reject cookies. Some browsers may have a “Do Not Track” setting. Please note that the Services are not designed to respond to “Do Not Track” settings.

We are not responsible for the effectiveness of, or compliance with, external-parties' opt-out options or programs or the accuracy of their statements regarding their programs.

Privacy Rights

Residents in California and Texas may have certain rights relating to their personal information as described below. Please note that we may need to authenticate your identity before your request can be processed. 

If you are an authorized agent submitting a request on behalf of a California or Texas consumer, please complete your authorized agent request by emailing us at [email protected] or by calling us at 800-828-0898. Requests submitted by authorized agents may also be subject to our verification process.

We will not discriminate or retaliate against you for choosing to exercise any of your privacy rights.

Right to Know: You have the right to know what personal information we have collected about you, which may include:

(1) The categories of personal information we have collected about you, including:

a. The categories of sources from which the personal information was collected.

b. Our business or commercial purposes for collecting, sharing, or disclosing personal information.

c. The categories of recipients to which we disclose personal information.

d. The categories of personal information that we shared, and for each category identified, the categories of third parties to which we shared that particular category of personal information.

e. The categories of personal information that we disclosed for a business purpose, and for each category identified, the categories of recipients to which we disclosed that particular category of personal information.

(2) The specific pieces of personal information we have collected about you.

Right to Delete: You have the right to request that we delete personal information we collected from you, subject to certain exceptions.

Right to Correct: If you believe that personal information we maintain about you is inaccurate, you have the right to request that we correct that information.

Right to Opt-Out of Sales, Sharing, and Targeted Advertising: You have the right to opt-out of the sale of your personal information, and to request that we do not share your personal information for cross-context behavioral or targeted advertising. To opt-out click the “Update Your Privacy Preferences” link in the footer of our Services. You may also exercise your right to opt-out of sales, sharing, and targeted advertising via an opt-out preference signal. If you choose to use the (GPC) browser signal you will need to turn it on for each browser you use.

Right to Appeal: Sometimes we are unable to process requests relating to your personal information, in which case, your request will be denied. If you believe we denied your privacy rights request in error, you may appeal for reconsideration of your request by submitting a request as outlined above.

Information for Residents of California

This section supplements the other parts of our privacy notice and provides additional disclosures for California residents.

We may sell and/or share with third parties for cross-context behavioral advertising the following categories of personal information:

• Identifiers;

• Internet or other electronic network activity information; and

• Geolocation data.

We sell and/or share this personal information to third-party advertisers and some analytics vendors solely via cookies and tracking technologies deployed on our Services. The purposes for which we sell and/or share this information include: showing you relevant ads while you browse the internet or use social media, marketing, certain types of analytics, or similar purposes. We do not have actual knowledge that we sell or share the personal information of consumers under 16 years of age.

We offer you the ability to opt-out of sales and sharing of your personal information as set forth above.

We strive to keep your personal information secure. We maintain reasonable administrative, technical, and physical safeguards designed to protect the personal information you provide us through our Services.   However, you should understand that no safeguards guarantee 100% security and that any use of our Services and transmission of personal information to our Services is at your own risk

Data Retention

We keep your personal information for as long as is necessary for the purposes described in this privacy notice, which generally means holding the personal information for as long as one of the following applies:

• Your personal information is reasonably necessary to manage our operations, to manage your relationship with us, or to satisfy another purpose for which we collected the personal information;

• Your personal information is reasonably necessary to carry out a disclosed purpose that is reasonably compatible with the context in which the personal information was collected; or

• We are otherwise required or permitted to keep your personal information by applicable laws or regulations.

Minors

Our Services are directed for a general audience and are not directed at minors. We do not knowingly collect personal information of consumers under the age of 18.
